Terms of Service

These Terms govern your access to and use of Sparkd, a SaaS platform for cleaning-business operations operated by Lopes2Tech (Switzerland). By creating an account or using the service you agree to these Terms.

1. The service

Sparkd provides crew scheduling, job checklists, photo evidence, time tracking, expense management, time-off management, client and property management, invoicing, and billing for cleaning businesses. Features available depend on your subscription tier (Freelancer, Team, Business, Enterprise, Enterprise+).

2. Your account

You must provide accurate registration information and keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account. You must be at least 18 years old and authorized to bind your organization. Cleaner accounts created by your organization are subject to the same Terms via the inviting owner.

3. Billing and seats

Subscriptions are billed monthly in CHF via Stripe and renew automatically until canceled. Seat caps apply per tier (Freelancer 1, Team 10, Business 25, Enterprise 50, Enterprise+ custom). On payment failure or trial expiry, the account enters soft-lock — reads remain available, writes are blocked until billing is resolved. Refunds are pro-rated for unused full months only.

4. Intellectual property

Sparkd, its source code, design, branding, and documentation are owned by Lopes2Tech. We grant you a non-exclusive, non-transferable license to use the service during your subscription. Content you upload (client data, photos, etc.) remains yours; you grant us the limited license needed to host, process, and display it as part of providing the service.

5. Warranties and liability

The service is provided 'as is' without warranties of merchantability or fitness for a particular purpose. To the maximum extent permitted by Swiss law, our aggregate liability for any claim arising from the service is capped at the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

6. Termination

You may cancel your subscription at any time from Settings → Billing; access continues to the end of the paid period. We may suspend or terminate accounts that violate these Terms, with notice where reasonable. On termination, you may export your data for 30 days; thereafter data is deleted per the Privacy Policy retention schedule.

7. Governing law and jurisdiction

These Terms are governed by Swiss law, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). Exclusive jurisdiction lies with the courts of Zurich, Switzerland, subject to mandatory consumer protection law in your country of residence.

8. Changes to these Terms

We may revise these Terms. Material changes are notified by email at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.
